General information

SEPIVA is in charge of managing and controlling the industrial security in the Valencian Community through Organismos de Control Autorizados (OCA- Authorized Control Agencies) that are in charge of verifying the mandatory requirements of products security and industrial installations, established by the Industrial Security Regulations, through certification, inspection, test or audit.

 

In order to be authorized to undertake its activities, any OCA requires prior approval by the National Accreditation Body (ENAC). Therefore, to request inspection of a facility, equipment or industrial product, the OCA needs to know in advance that they are authorized to act on the regulatory field needed.

1. What do the Industrial Security Regulations establish?

  • The technical and safety requirements must be met according to subject facilities, equipment, processes, industrial products and their use as well as technical procedures for assessing conformity with the above conditions or requirements.
  • Measures must be taken by holders for the prevention; restriction and cover of risks arising from the activities of the facilities or the use of products.
  • The terms of equipment, resources and technical capacity and, where appropriate, the necessary authorization to individuals and companies involved in the project, construction supervision, implementation, installation, maintenance and facilities maintenance and industrial products.
  • The installations, equipments and industrial products must be built or manufactured according to the Regulation, which can demand the checking of performance and maintenance through periodic inspections.
  • The Security Regulations can put some conditions for the performance of certain installations and for the use of some products that certify fulfilment of the regulations in the terms established by them.

2. How can the performance be certified?

Compliance with regulatory requirements relating to industrial security, subject to review by the Public Administration, will be tested by any of the following means, in accordance with which the implementing regulations that may apply:

  • Declaration of the premises and, when needed, the manufacturer, its agent, distributor or importer of the product.
  • Certification or Control Agency Act, authorized installer or conservative or competent professional technician.
  • Any other means provided for in Community law.

The test may provide a basis for action by the competent authority under the relevant regulations.

3. What must the owner of the installations do implementing them?

The industrial security does not end with the commissioning of the facilities and equipment, but it demands that these security requirements are maintained throughout their useful life, for which the owners should undertake preventive work based on the achievement of adequate maintenance of these facilities and equipment, in general, with the participation of authorized maintenance companies.

 

Furthermore, there is an obligation to verify the functioning and state of preservation or maintenance of facilities and equipment by performing periodic inspections to demonstrate that they continue meeting the security requirements imposed for Industrial Security.
